Copyright Clearance Center = FAIL

Sometimes, it’s just nice to laugh at industries that are desperately attempting to hang on to their relevancy in a changing world. Exhibit A for today is the Copyright Clearance Center, and their interesting attempt to educate users about copyright via their Copyright Basics video. Let’s examine the ways in which CCC fails at modern web usage.

First: here’s the opening screen of the video

I think that’s enough said, yes? Among the nearly-unreadable text is the prohibition to “distribute copies of the Program to persons outside your company, or post copies of the Program on any public website (including any video sharing or social networking site).”  Yep, that’s the CCC…all about education. Wouldn’t want those non-paying people to easily get your content that explains why they should pay for your content. 

Second: To get a copy of the video to use internally, on a non-public server that is limited to only your employees, you have to fill out a form on this page. Or, you know, just look at the page source:

Where the FLV file is handily linked for anyone who might want to use it. 

If ever there was a direct example of how the modern web breaks copyright, the CCC just gave it to us. The answer, of course, isn’t to ignore the de facto standards for the distribution of video on the web, to limit the ability to share and distribute content, and to generally treat people who want to use your content like criminals. The way to make yourself valuable and heard is to share what you make as widely as you possibly can…something that the CCC can’t bring itself to do. It’s really hard to participate in the modern conversation when your very business model is tied to archaic and irrelevant legalese.

BIGWIG Social Software Showcase 2009

It’s hard to believe that it’s already time to start the planning for the BIGWIG Social Software Showcase 2009, but indeed it is! We’re going to be swapping up the format just a little bit this year, but the thing that isn’t changing is that we want the library community to tell us what they want to hear about. For those who may not have attended the SSS over the last couple of years, here’s how it works:

Step 1: We put out an open call for topics to the library world. You tell us the topics you want to hear more about.

Step 2: We find experts on those topics who are willing to participate in the Showcase.

Step 3: Those experts prepare a web-based presentation on their topic, and put it up sometime before ALA Annual 2009.

Step 4: At Annual 2009, those same experts will attend the Showcase and will discuss their topic, answer questions, tapdance, and otherwise entertain and educate. The format is slightly different every year, but the Showcase at Annual 2009 will be fun, educational, frantic, interesting, and guaranteed different than any program you’ve ever attended at an ALA Conference.

Step 5: After ALA, the conversation will continue online, on YourBIGWIG and other places.

Come join us for one of the most interesting presentations you’ll ever see, and more importantly, help us put it together! The “social” in “Social Software Showcase” isn’t just about the tools, but about the process as well. Be a part!

CluetrainPlus10 – Thesis 17

Companies that assume online markets are the same markets that used to watch their ads on television are kidding themselves.

As many will probably say about The Cluetrain Manifesto, it’s almost scary how precient it was. To put it into perspective, when the authors were writing Cluetrain, Google had less than a dozen employees and has just moved out of a garage. The word “blog” had yet to be used to describe a chronological website. Napster hadn’t shattered the media industry yet. And statistics put the number of people on the Internet at just about 150 million, or around 10% of the current number.

Christopher Locke, Rick Levine, Doc Searls, and David Weinberger put together an amazing set of principles that are even more relevant today than they were 10 years ago.  The sad part about Thesis 17, in particular, is that companies haven’t yet learned this lesson. Some of them are trying, with standouts like Zappos. But far too many companies are failing to see the benefits of participatory marketing and extreme customer service.

The market is no longer passive. Almost no one under the age of 35 these days interacts with products in the way the older generation did…we expect to be involved in our consumption, connected to it. We ask friends, we poll our social networks, we take recommendations of the people we know very seriously. We have to love both the object and the process or we just don’t buy. And loving means becoming involved, knowing more, interacting with the makers, asking questions, and otherwise being active.

We want a relationship with our products, and producers who try to feed us advertising may be ok short-term, but the days of the passive are over. The new market is fragmented and participatory, and content producers will have to adjust or die. Making a better product isn’t enough. The companies that will thrive in the coming years are the ones that understand and cultivate the one-to-one relationships with their customers and their potential customers.

Kindle 2 on Techsource

Just a note for those that might have missed it…I’m one part of a three part post over at TechSource on the Kindle 2 and libraries. I’m pointing it out mainly because of the fact that I did the very first, I think, video for TechSource, showing off the Kindle 2’s Text-to-Speech feature. Gmail hack

Not sure how many people know about this gmail hack, but it’s come in handy for me recently, so I thought I’d throw it out. Suppose you have an account on a service like Twitter, but now need to sign up for a different username, or just want one account for business and one for personal use. Twitter (and other services) won’t let you use an email that is already in their system to sign up for a new account.

Here’s where the gmail hack comes in. Gmail has one feature and one bug that allows you go get around having to have a secondary email address. The first is that Gmail allows you to create an infinite number of + aliases for your gmail account, in the format:

griffey+TEXTHERE@gmail.com

You can use any text at all after the plus sign, and gmail will ignore it completely for the purposes of delivering the email to you, but WILL let you filter and search on it. So I could set up a second twitter account called fakegriffey, and give it the email address griffey+fakegriffey@gmail.com, and Twitter will let me, since that isnt in their database. Gmail will happily deliver it to my griffey@gmail account, and all is well.

The other hack is that Gmail completely ignores periods in any account name for delivering email. griffey is the same as gri.ffey is the same as griff.ey is the same as g.r.i.f.f.e.y. By giving Twitter some variation, you can get around their email limit and still keep your email organized.

Ebooks, copyright, and the University of Virginia

I’m in the middle of writing a book about Mobile Technologies and Libraries, and am researching libraries providing mobile-specific services of all sorts. I came across the University of Virginia’s Ebook Library, and decided to take a look at what they are offering. It’s a very old ebook collection, with the original Etext division starting in 1992. Here’s the part that made me scratch my head…it’s in their Access and Conditions of Use:

While many of these items are made publicly-accessible, they are not all public domain — the vast majority of the images, and a number of the texts, including all of those from the University of Virginia Special Collections Department, are copyrighted to the University of Virginia Library, for example, and a number of other texts are still copyrighted to their original print publishers and made available here with permission.

I have no qualms with the texts that are copyrighted by their original publishers, and that UVA got permission to use. My eyebrows raise at the bit about “including all those from the University of Virginia Special Collections Department, are copyrighted to the University of Virginia Library…”

Really?

I had my suspicions here…it’s not like the UVA Special Collections Department are writing books, right? After look around, I found this text: Po’ Sandy by Charles W. Chestnutt. Published in 1888 in the Atlantic Monthly in New York, it is clearly in the public domain in the United States. But there it is, in the front matter:

Copyright 1999, by the Rector and Visitors of the University of Virginia

Looking around just a bit, it looks like this shows up on all sorts of texts that UVA digitized. My favorite is The Autobiography of Benjamin Franklin, completed in 1788 by Franklin but the particular version republished by UVA was published in 1909 by P. F. Collier & Son Company in New York. Also, without any doubt, in the Public Domain in the US. It also has the note:

Copyright 1999, by the Rector and Visitors of the University of Virginia

What gives UVA the right to claim copyright on these texts? They couldn’t have legally digitized them if they weren’t in the Public Domain at the time of their digitization, and changing the form of something doesn’t give you the right to claim a copyright, especially on the bits that make the work up. Even stranger, they aren’t just claiming copyright, but including a EULA!

By their use of these ebooks, texts and images, users agree to follow these conditions of use:

  • These ebooks, texts and images may not be used for any commercial purpose without permission from the Electronic Text Center.
  • These ebooks, texts and images may not be re-published in print or electronic form without permission from the Electronic Text Center. However, educators are welcome to print out items and hand them to their students.
  • Users are not permitted to download our ebooks, texts, and images in order to mount them on their own servers for public use or for use by a set of subscribers. Individuals and institutions can, of course, make a link to the copies at UVa, subject to our conditions of use.

Really? Is UVA asserting rights here that they just do not have? Not permitted to republish? Only if there is a copyright concern…which I think that UVA is asserting incorrectly here. It’s possible that there is some piece of copyright law that they are leaning on for these claims, but on the face of it, this seems like over reaching. Can anyone explain to me how they could possible have legitimate copyright claims on things that they didn’t create and are beyond the time limit for copyright protection in the US?

TechSource Post: Saving Your Digital Life

Just put a new post up over at ALA TechSource: Saving Your Digital Life. Here’s a blurb:

I have, basically, three kinds of data that I’m worried about protecting in some way: working files, files that are important but replaceable, and files that I can’t afford to lose at all. Working files are just that: files that I’m currently working on for whatever reason. Might be a photo I’m editing, or a document, or an MP3 that I need to move to another computer…anything that requires action. Files that are important, but replaceable, are things that make my life easier if they are in digital form, mostly media. DVDs I’ve purchased and CDs I own have all been digitized, because I want to be able to watch them when I want and not when I remember to have a disk of plastic with me. I also want to be able to move them to my iPhone or other portable media player. If I lose the digital, it’s ok, because I can just re-digitize them, but I really, really don’t want to have to do that. And finally, there are the files that I just can’t lose for any reason. Things like tax returns, photos of my daughter, receipts, and other digital items that need to be safe even if there’s a natural disaster.

So how do I handle all of this? With one piece of hardware, a few pieces of software, and broadband.

Hack of the week: Dropbox

I’m really particular about the background images on my computers. I like dark, subdued backgrounds that don’t attract the eye. I do like pictures, but ones that highlight any icons easily and don’t strain my eyes trying to find what I’m looking for. As a result, I’ve spent years collecting images that I like, upgrading to higher and higher resolutions as my monitors got better and better. I’ve got tons of fractals, dark photos, and other such images that I just prefer to have as my desktops.

Oh, and a few pictures of Eliza, of course.

So previously, I’ve kept a copy of this “Wallpapers” folder at the root of whatever computer I’m using, and set the system to use that as images for the desktop. But then if I find a new image I like, I’ve got to remember to distribute it to my laptop, and my home desktop, and my work desktop…blah.

Enter: Dropbox. Now hopefully everyone knows how amazingly awesome dropbox is by now, but if you don’t, just click that link and sign up for it. Trust me. Dropbox creates a folder on each of your computers that you install it on, and a folder in the cloud, and keeps all of them in sync all the time. You get 2 gigs free, and can pay for extra space as you need it.

I just realized that I can now put a Wallpapers folder inside my Dropbox, and it will propagate to every machine. I can set my desktop pics to choose from that folder, and anytime I find a new one, it will automagically sync to all the others with no effort from me. So all my pics will be the same on all my machines, no matter which I find and add from. It’s a little thing, but it makes me happy.

Inherit the Wind

There has been a conflation of blog posts and news stories that have really set my brain on fire this week, starting with an amazing post and comment discussion over at Walking Paper by Aaron Schmidt.  Then there was a quick email conversation with Michael Porter about the future of libraries if we don’t get ahead of the digital content curve and fast. On top of all that, someone pointed me to the  amazing “future of education” slideshow that I linked to yesterday by Dr. David Wiley. And now David Lee King puts together this amazing post about The New Normal, which links out to yet more stories about how the Music Industry and other once-solvent American institutions are undergoing change so radical as to make what comes out the other side almost unrecognizable.

In the midst of all this, at MPOW we are building a new library. So I’m thinking a LOT about several different time horizons. How do I plan for the realities of opening a new library in 2-3 years, but still allow for what I see as the likely outcomes for collections, services, and such in 5, or 10, or 20 years? This is a non-trivial problem…while no one can really tell whats coming, we have to remember that we are creating the future every day.

I agree with David on most of his points, but some of it bears repeating. Here are the sort of “talking points” that I’ve been rolling around in my head for the last month or so.

  • It isn’t likely that any major national newspaper will still be in print in 5 years.
  • Magazines will almost certainly follow…their collapse may be more slow motion because they have a different advertising base, but it will come.
  • Hardcover books are next to go. They are, in effect, just publicity engines.
  • After that, I’m betting that the slowly-dwindling dead-tree printing that is done becomes, essentially, a beskpoke process where there are paper-fetishists who purchase “books” for their sensory natures. But 99.9% of publications will be digital.

In addition to this 5-10 year spiral, we have the parallel procedures of the major content providers hoping to rent the future to us digitally. Ebook models have been unilaterally horrific, insisting on DRM that only punishes the hopeful consumers of the printed word. Digital video and audio on a consumer level are starting to come around, with the iTunes store being the last major consumer provider of digital audio to go DRM free. Consumer video is slowly moving from a subscription-subsidized with advertising model like cable to a free-streaming, a la carte, advertising based model like Hulu, but even there content creators are still fighting the inevitable by insisting that only they get to decide where media can live.

Content providers have insisted on holding tight to a model of selling their wares where content is scarce, connections are hard, and communication is expensive. We live in a world, however, where content is ubiquitous, connections are trivial, and communication is essentially free. These two worlds cannot coexist, and library vendors from Overdrive to OCLC must change their models. If they don’t, they will die as certainly as newspapers, magazines, the recording industry, television, and printed books.

Where does all of this leave the library? As the analog dies and the digital rises, unless we get in front of the content providers and claim our place at the digital table, we run the risk of being increasingly marginalized. There are places for us in this new world, but we need to make them, to carve them from the bytes. Stewart Brand’s comment that “information wants to be free” has never been more true, but just because it wants to be free doesn’t mean it doesn’t need caretakers.

The title of this post is inspired by a quote from Eric Hoffer, who said: “In times of change, learners inherit the Earth, while the learned find themselves beautifully equipped to deal with a world that no longer exists.” In this brave new world, libraries and librarians must be learners. If not, we run the risk of inheriting not the information-rich digital world of the future, but the wind.

Ebooks explode this week

This week, ebooks were all over the tech news, and there were at least two huge announcements. Well, one announcement, and one not-so-secret launch coming Monday.

The announcement was the Google Book mobile service, which gives users access to 1.5 million books from the Google Book scanning project OCR’d and formatted for mobile screens, like those of the G1 and the iPhone. In one fell swoop, Google has made these platforms the home of the largest electronic book library in the world…the Amazon Kindle store currently has 230,000 books, while Project Gutenberg has just over 100,000.

The upcoming announcement is that almost certainly on Monday, Amazon will announce the Kindle version 2. Leaked photos make the v2 look sleeker, more updated, and with much better physical form-factor. What I’m most excited about is the possibility of v.2 of the software, which better UI and possibly more features. As long, of course, as the software is ported back to the original hardware.

Are these the things that will finally push ebooks firmly into the public consciousness? Time will tell, but I can hope.
