FWIW, I forwarded a link to Jason's paper to the ALA Council mailing list with a few notes that I thought it was interesting, had some thoughtful things to say and received exactly zero [0] responses.

re: bad faith

I didn't read the same intent (or the possibility of that intent) in the paper. Maybe I give ALA too much benefit of the doubt, but I see the disconnect that Jason points out as being a function of ALA not being on the ball on the issues of copyright and open access. It looks hypocritical, but I wouldn't ascribe bad faith on ALA's part. As I think I described it to Gorman: one hand doesn't seem to know what the other is doing. And if I had to pin the motive for this on something, I would lay blame on organizational confusion and the lack of prioritization on this issue. I think it does undermine ALA's overall position, but I don't believe that the org. is doing it on purpose or with ulterior/sinister motives.

My apologies for the use of the phrase "preordained conclusion," which in retrospect appears to imply bad faith on your part. That was not my intent and I don't believe it is true. And it is doubly ironic that it came up in the course of a discussion informed by my own concern that your report unjustly suggested ALA has acted in bad faith. I look forward to seeing how the paper develops as you work through the issues at hand.
