Once more the Apple apologist

I’m feeling more and more like the library equivalent of John Gruber these days.

UPDATE 2/1/11 1:18pm: website The Loop is reporting that they received a statement on the matter from Apple:

“We have not changed our developer terms or guidelines,” Apple spokesperson, Trudy Muller, told The Loop. “We are now requiring that if an app offers customers the ability to purchase books outside of the app, that the same option is also available to customers from within the app with in-app purchase.”

This is a change from previous Apple requirements, and will require existing apps to make changes to the way they behave. It also puts Amazon, B&N, and other retailers far more under Apple’s thumb in regards to pricing and profitability. More than anything, it puts them in a confrontational position with other retailers, instead of being simply a competitor. It will be very interesting to see how this shakes out.

There has been general alarm this morning on the Twitter and in the blogosphere that Apple is going to start killing off non-iBook eBook stores. Phil Bradley blogged about the New York Times article on the rejection of the Sony eReader app by Apple, saying:

Well, this is an interesting development. Sony have had their iPhone application rejected by Apple. Moreover, they’ve been told that they can no longer sell content, like e-books, within their apps, or let customers have access to purchases they have made outside the App Store.

That is what the NYT article says as well:

The company has told some applications developers, including Sony, that they can no longer sell content, like e-books, within their apps, or let customers have access to purchases they have made outside the App Store.

But if you read the next two lines:

Apple rejected Sony’s iPhone application, which would have let people buy and read e-books bought from the Sony Reader Store.

Apple told Sony that from now on, all in-app purchases would have to go through Apple, said Steve Haber, president of Sony’s digital reading division.

Notice that Steve Haber did NOT say that non-in-app purchases were disallowed. I can’t tell from the sloppy reporting if that second clause actually came from the Sony interview, or from other sources. So here’s the deal: Apple has never allowed in-app purchases that bypassed Apple. It’s the reason that when you are in the Kindle app, and you go to buy a book, it pushes you out of the app and over to Safari and the Amazon website.

There seems to be no indication that the Kindle app is in jeopardy…Phil’s headline notwithstanding. It works exactly the way that Apple has told people it wants apps to work, and if Sony submitted an app that didn’t follow the rules, they knew good and well it would get rejected.

There is another explanation…Apple might be warning app developers behind the scenes that things are going to be changing. Tomorrow marks the announcement of The Daily, Rupert Murdoch’s new experimental tablet-only newspaper. With it is expected to come a new method for in-app subscriptions, which might signal the availability of a new infrastructure for app developers to take advantage of (and for Apple to force the use of).

But for now, this story is nothing but poor reporting on the NYT’s part, combined with a bit of over-excitability on the part of librarians. Amazon’s Kindle app, along with the literally thousands of other apps that rely on web-based purchasing and then web-based updating, isn’t going anywhere. Apple would have many, many, many more problems than Amazon if they just eliminated outside purchases wholesale.

eBooks, filetype, and DRM

This morning I got a tweet from Bobbi Newman that said:

More than you ever wanted to know about filetypes, DRM, and eBooks…here we go.

There are two different things going on when someone tries to open an eBook file on an eReader. One is filetype…how the file itself is organized internally, how the information contained within is encoded. This is analogous to the difference between a Word file saved as a .doc file, a Word file saved as a .docx file, and an Powerpoint file (.ppt). All are different filetypes…the program involved in the creation, editing, and display of those files describes the information contained inside. Right now, there are two main filetypes being used to describe eBook files: the Amazon eBook standard, or .amz file, and the ePub file (.epub) that is used by just about every other eBook vendor.

Amazon  purchased Mobipocket (an early ebook vendor/distributor) way back in 2005, and used their format as the basis for their current proprietary .amz filetype. ePub, on the other hand, is an open, XML based eBook standard, and is used by a huge number of eBook vendors…indeed, it’s easily the standard for current ebook publishing.

But filetype is only half the battle. In addition to the way the file is organized/structured internally, there is also Digital Rights Management to deal with. Think of DRM on an eBook as a lock, with your eReader having the key to open the lock and display the file. Without the lock, the eReader can’t open the file at all…can’t even see what it is. And if it has the key, but can’t read the filetype, that’s no good either…in that case, you can view the contents of the file, but will have no idea how to render it on the screen properly.

Amazon, in addition to using a proprietary filetype, also uses a proprietary DRM mechanism. This means in order to read an Amazon-purchased eBook, you have to have an eReader with the right key, as well as the right interpreter for the file. So far, that means that you have to be using a Kindle, or alternatively, using the Kindle software provided for any number of other devices (Windows, Mac, iOS devices, Android devices). This doesn’t mean that’s the way it has to be. Amazon could choose, tomorrow, to remove all DRM from their files. This would mean that you’d still need a program to interpret the .amz, but you wouldn’t need the key anymore. Conversely, Amazon could license their DRM to other eReaders, in effect handing them the key…but it would still be up to the eReader itself to be able to display the .amz file.

Vendors that use the ePub format have chosen different sorts of DRM to lock up their content. Apple and their iBook app use the ePub format, but wrap it up with their Apple-specific Fairplay DRM. This means that while the file itself would be readable by any device that can interpret an .epub file, without that particular key on their keyring, the eReader can’t do anything. Sony, Barnes & Noble, Overdrive, and other eBook vendors have chosen a shared DRM solution. They license their DRM from Adobe, and run Adobe Content servers that provide the keys to epub files that they sell. This means that if an eReader has the key to one of those stores, it has the key to all of them…think of it as a shared master key for any Adobe DRM’d file.

This illustrates why, although both Apple and B&N use epub as their filetype, you can’t buy a book from the B&N store and then move it over to your iBook app on your iPad. Conversely, you can’t buy something on the iBook store, and then move it to your Nook. Same filetype, different lock.

Overdrive, in supporting Adobe DRM’d epub files, work with Sony eReaders as well as the B&N Nook…same filetype, same DRM key to unlock them.

With all that said: any eReader that will read a given filetype will read said filetype if the file doesn’t have any DRM. So if you convert an existing document to an epub using software like Calibre, Sigil, or InDesign, that file will able to be read on a Nook, Sony Reader, AND the Apple iPad/iPhone/iPod Touch. If you have some text and you convert it to, say, a Mobipocket file (.mobi or .pdb) then it would be readable on the Kindle AND the Apple iBooks app…but not on the Nook. While a DRM free eBook ecosystem would clearly be the best for the consumer (choice of device, free movement of files from device to device, etc), the second best option is an ecosystem where the DRM is ubiquitous and the patron doesn’t even realize it’s there. This was the case with Apple and the early battles for music sales on the ‘net…they had the store and the distribution network (iTunes) as well as the device used to access the content (iPod). All of the content was, originally, DRM’d, but largely no one noticed since it was completely invisible for the average user.

The biggest issue with eReaders and library patrons is that this chain isn’t seamless. The content providers and their DRM servers are huge headaches for the average eReader user. My hope is that publishing goes the same way that music did, we we find both a common filetype and lose the DRM. But it took digital music years and years to get there…so I’m not holding my breath.

Amazon, Zappos, and Libraries

So yesterday brought the news that Amazon acquired Zappos. For those not familiar, Zappos is a company that sells shoes (primarily, although they now sell other things) and is known for its nearly insane customer service. Seriously, they will do just about anything they can to make sure you’re happy, and are responsible for crazy customer service stories. This story about Zappos sending a woman flowers is maybe my favorite customer service story of all time. My other favorite thing about them is their “Pay new employee to quit” program.

As a result of the acquisition, Amazon CEO Jeff Bezos released this youtube video

Take a minute, and watch the video…it’s worth it.

So Jeff explains a bit about the deal, and why Zappos and Amazon are a good match. According to Jeff, he only knows these things:

  • Obsess over customers
  • Invent
  • Think Long Term
  • It’s Always Day 1

Why do I mention this on what is ostensibly a blog about library science stuff? Because I feel strongly that our future isn’t in content, really…it’s in services. No one does service better than Zappos. If we take Zappos customer service strategy (do anything to make the customer happy) and the four things that Jeff Bezos knows about running a company, how could we change libraries for the better? What can we do to be the Zappos of information?

Kindle 2 on Techsource

Just a note for those that might have missed it…I’m one part of a three part post over at TechSource on the Kindle 2 and libraries. I’m pointing it out mainly because of the fact that I did the very first, I think, video for TechSource, showing off the Kindle 2’s Text-to-Speech feature. The Kindle and Reference 2.0

Ok, so we’ve all seen the press, read the Newsweek story, and if you’re reading this you probably read my take on the Amazon Kindle. Here’s a new feature that wasn’t heavily marketed for the Kindle, that has a direct impact on library efforts…and the surprising thing is, it has nothing to do with reading a book.

I’m talking about Amazon NowNow.

It’s an “experimental” feature on the Kindle, but NowNow is a human-powered answer engine that uses the Amazon Mechanical Turk group to search and answer questions for users. The service is in beta, and has been for a year or so (Jessamyn blogged about NowNow back in January).

So what’s the big deal? Well, the Kindle is an always-on internet appliance…anywhere you can get a cell signal, you can be online with the thing. Which means that you can ask a question and get an answer, from nearly anywhere, from a human, emailed directly to the device you used to ask the question in the first place. And this is built into the device…yes, Amazon might decide to charge for this, but right now they aren’t.

Is this Reference 2.0? Imagine being asked a research question by a patron, finding the perfect article for them, and being able to send that article to the device they are going to use to read it. Yes, I realize that laptops sort of fill this goal already, but the Kindle is certainly a more user-centered way of getting at this process. The patron doesn’t have to find a way to ask us questions…the device they are using is a direct line to us. It might not be that distinct from a webpage with a meebo widget…but I think it is qualitatively different somehow.

More on the Kindle

Wow!

The Kindle is for sale at Amazon right now, and the details of the device are intriguing. More highlights:

  • It connects to the net via cellular networks, specifically EVDO. So anywhere you can get a cell signal, you can buy a book. And there is no charge for the connectivity…Amazon is underwriting it.
  • There looks to be subscription models for newspapers, magazines, etc, all delivered automatically in the background. Wake up every morning and the Times is waiting.
  • New York Times® Best Sellers and all New Releases $9.99, unless marked otherwise.

And, my favorites:

  • Includes free wireless access to the planet’s most exhaustive and up-to-date encyclopedia—Wikipedia.org.
  • By using the keyboard, you can add annotations to text, just like you might write in the margins of a book. And because it is digital, you can edit, delete, and export your notes, highlight and clip key passages, and bookmark pages for future use.
  • The source code for the device appears to be available…one can only guess that they leveraged some open source software and are complying with the license. Except that it’s machine readable source…hmmmm.

Here’s the bad:

  • They are advertising “more than 250 top blogs…” I take this to mean there is no open RSS reader built in. That seems a nearly criminal omission from the Kindle. I mean, RSS is the backbone of content choice on the web right now…come on Bezos!
  • It does support ebooks via Audible…so you can read or listen, as you choose.
  • From the License Agreement: “Amazon provides wireless connectivity free of charge to you for certain content shopping and acquisition services on your Device. You will be charged a fee for wireless connectivity for your use of other wireless services on your Device, such as Web browsing and downloading of personal files, should you elect to use those services. We will maintain a list of current fees for such services in the Kindle Store.”
  • And here’s a good one: “You agree you will use the wireless connectivity provided by Amazon only in connection with Services Amazon provides for the Device. You may not use the wireless connectivity for any other purpose.”

Ah, and here’s where eBooks and physical books diverge, and is the source of 99% of my frustration with the format (also from the License Agreement):

Use of Digital Content. Upon your payment of the applicable fees set by Amazon, Amazon grants you the non-exclusive right to keep a permanent copy of the applicable Digital Content and to view, use, and display such Digital Content an unlimited number of times, solely on the Device or as authorized by Amazon as part of the Service and solely for your personal, non-commercial use. Digital Content will be deemed licensed to you by Amazon under this Agreement unless otherwise expressly provided by Amazon.

Restrictions. You may not sell, rent, lease, distribute, broadcast, sublicense or otherwise assign any rights to the Digital Content or any portion of it to any third party, and you may not remove any proprietary notices or labels on the Digital Content. In addition, you may not, and you will not encourage, assist or authorize any other person to, bypass, modify, defeat or circumvent security features that protect the Digital Content.

That book you bought? Not yours. Can’t sell it. Can’t even give it away.

Oh, and for those librarians who still hold tight to the privacy bandwagon:

Information Received. The Device Software will provide Amazon with data about your Device and its interaction with the Service (such as available memory, up-time, log files and signal strength) and information related to the content on your Device and your use of it (such as automatic bookmarking of the last page read and content deletions from the Device). Annotations, bookmarks, notes, highlights, or similar markings you make in your Device are backed up through the Service. Information we receive is subject to the Amazon.com Privacy Notice.

They know when you are reading. They know what you are reading, and that you bookmarked the sex scenes. Oh yes, they know.

So, exciting new product? Yep. Amazon, like Apple before them, has realized the power of a closed market segment, where they control the distribution and the consumption of media. The real test will be whether this survives the 2-3 year adoption cycle and moves into the magic price point range ($100-150).

Amazon Kindle

Amazon KindleHow’s that for a librarian’s dream? The Kindle, Amazon.com’s new eReader, launches tomorrow, and Newsweek has an article online about the new, possibly revolutionary, product.

I can’t do a complete thinkpiece on the Kindle right now, but over the course of the week I’ll get to my take on the device. There are still lots of questions unanswered (the wireless connectivity charge, for one), but here’s the quick take to be expanded on later:

  • This could very well be the iPod for books. It is revolutionary.
  • Libraries seriously need to get their heads on straight regarding copyright law and licensing. If we don’t do some very, very serious lobbying very, very soon, eBooks will kill the current library model. We really need to do some serious thinking about how this impacts us.
  • It is too expensive. For $400 I can buy a laptop (or two!) and do many more things on it.
  • I want one.
